COVID REFUND GUARANTEE
1.1 In these uncertain times, it is reassuring to know that if you are unable to travel to take your holiday because of a national lockdown, or because you are put into Tier where you are unable to travel, we will give you a full refund. Please note that the refund guarantee applies only to the address given on the booking at the time of the booking being put in a high tier, and when the travel restriction coincides with the period of your holiday. The refund guarantee covers lockdowns and Tier restrictions but does NOT cover you (or members of your party) for being unable to travel because you (or a member of your party)fall ill with Covid or are required to quarantine or self-isolate. These events can be covered by you taking out travel insurance. There are several policies that include cover for illness with Covid and self-isolation you can look for suitable cover on comparison sites. Please see our Cancellation Terms below for further information.
The Contract for a short-term holiday rental will be between the owners of Atlantic View (“us” or “we”) and the individual placing the booking and all members of the holiday party (“you”,”your”,”guests”) under the following booking conditions. The name of the person on the booking form (party leader) guarantees that he/she has the authority to accept and does accept the terms and conditions on behalf of all members of the party booking. The party leader must be at least 18 years of age at the time of booking and is responsible for listing all names ages and addresses of all party members staying at Atlantic View on request. The party leader must personally stay at Atlantic View throughout the holiday and is responsible for all payments due, notifying us in writing if any changes or cancellations are required as well as for the conduct of the other members of the party. No Stag or Hen parties will be accepted at any time. When you submit a booking through our online reservation system you will receive an automatically generated booking summary by email to the email address you provide on your booking form. The contract of hire is not effective until we have processed your deposit. The contract will be subject to these conditions and must be compiled with UK law will govern the contract.
A 25% deposit is required to secure your booking with the balance payment then due six weeks prior to the start date of your holiday. If you are booking within 30 days prior to the start date of your holiday, then full payment is required. We will email you to remind you when the balance is due, and at the same time will confirm any special arrangements. We reserve the right to cancel a holiday where payment has not been received by the due date.
Customer inability (or the inability of any, some, or all your intended party) or disinclination to travel to and stay at Atlantic View for any reason. This includes – but is not limited to – illness (including Covid), a requirement or recommendation to self-isolate or quarantine, shielding, a call to jury duty, military service, incarceration, change in personal or work circumstances, family emergencies, travel delays, vehicle breakdown, and delays with public transport. These remain at your risk and do not give rise to a right to cancel or receive a refund, other than according to 1.2 or 1.3 below All cancellations must be notified to us by email firstname.lastname@example.org
Cancellation insurance is not compulsory, but we strongly recommend you purchase UK travel insurance, then you accept responsibility for any loss that you may incur due to your cancellation.
There are several suitable options which include cover for COVID-related cancellation on comparison sites such as www.gocompare.com, where you can check which policy will be best for your particular requirements. We are not selling, promoting, endorsing, or recommending any particular product, and do not benefit financially or have any formal relationship with any of the providers.
1.2 If there are fewer than 60 days before the start of your stay, with the exception of 1.1 above, any refund we give you will be subject to our ability to find an alternative booking. If we are unable to find an alternative guest for the period of your booking, we will not offer you a refund. If we are able to find an alternative guest for the period of your booking, you will be entitled to a refund equal to the lesser of:
(a) The cost of your booking, less an administrative charge of up to £70-00 to cover the cost of cancellation and remarketing the cottage (these costs include our admin costs, remarketing costs, bank fees, accounting fees, and agency fees or commission payments.) or
(b) The fee paid by the alternative guest for the accommodation, less our administrative charges described above, and any refund under this clause will be made within 14 days of the booking start date.
1.3 If there are more than 60 days before the start of your stay, we will offer you a full refund on cancellation, subject to an admin charge of up to £70-00.
CANCELLATION BY US
In the event that we are unable to provide the accommodation as stated due to circumstances beyond our control (eg fire, flood, exceptional weather conditions, damage/destruction) Atlantic View may, at its sole discretion, offer you:
- a) a full refund: or
- b) alternative holiday dates: or
- c) such other remedy as Atlantic View considers appropriate with regard to the circumstances.
Liability is restricted to the return of all monies paid. If we have to terminate your holiday early you will be refunded part of the booking fee based on the time remaining of the booking. No additional compensation, expenses, or costs will be payable.
You may access the property after 4-00 pm on the day of arrival (earlier arrivals are strictly by arrangements only). Please note that departure is by 9-00 am on your final day (again, later departures are strictly by arrangement only) We need this time to ensure that the cottage is ready for the next guests. You must not use the property except for the purpose of a holiday during the holiday period, and not for any other purpose or longer period. The agreement to stay in the property for the holiday period does not create the relationship of Landlord and Tenant between the parties. You shall not be entitled to a new tenancy, or to any assured shorthold or assured Tenancy or any statutory protection under the Housing Act 1988 or other statutory security of tenure now or at the end of the Holiday Period. On departure, you are requested to leave the accommodation in a clean and tidy condition. This includes washing up, placing rubbish in bin liners, and putting in the outside bins, ensuring ovens and hobs are clean and free from grease.
NUMBER OF PERSONS USING THE PROPERTY
No more than the stated maximum occupancy level of any cottage may be exceeded at any time during the booking. A cot sleeping infant, under the age of 2 years on arrival, maybe an additional person and will share their parents’ room. We reserve the right to refuse to hand over to you or to repossess the property if the number is exceeded and will treat these circumstances as a cancellation by you.
OTHER PROPERTIES AT ATLANTIC VIEW
There are four properties at Atlantic View, and all are being enjoyed by other groups and families. As part of your booking, you agree not to do anything that may reasonably be considered to cause a nuisance or annoyance to the occupiers of adjoining Cottages. We reserve the right to repossess the property if this agreement is breached and will treat these circumstances as a cancellation by you.
CARE OF THE PROPERTY
You are responsible for the property and are expected to take all reasonable care of its furniture, pictures, fittings, and effects, in or on the property. You must leave them in the same state of repair, and in the same clean and tidy condition at the end of the rental period as at the beginning. Take care when using fake tan, sun cream, waterproof make-up, hair dye, or similar substances in the property because they mark or stain linen, towels or other furnishings. If you plan to use such a product at the property we recommend that you bring your own spare bedding and towels. If damage is caused that cannot be cleaned a bill will be forwarded to you. You must not use the property for any dangerous, offensive, noxious, noisy, immoral activities or carry on there any act that may be a nuisance or annoyance to the owner or other neighbouring properties. Fireworks and Chinese lanterns, must not be used in the cottage grounds.
YOU WILL BE CHARGED £35-00 IF THE BARBEQUE IS NOT LEFT IN THE SAME CLEAN CONDITION ON YOUR DEPARTURE.
DAMAGES AND BREAKAGES
In the event of damage to the premises or equipment, you must inform the owner immediately. You are legally bound to reimburse us for the replacement or repair costs on demand. However, we will use our discretion with smaller items such as glasses and plates. You are legally bound to reimburse us for replacement, repair, or extra cleaning costs on demand. Replacement keys will be charged at £10-00 per key.
SMOKING OR VAPING
Smoking or vaping is STRICTLY prohibited in all the properties listed on Atlantic View’s website.
TOWELS AND LINEN
All bed linen, towels, and kitchen towels are supplied with the exception of cot bedding.
Please take reasonable steps to ensure that the property you book is suitable for your needs. Please ensure you familiarise yourself with the property access, facilities, layout, grounds, and/or garden so that you can make a fully informed decision about a property’s suitability to your requirements, needs, and taste prior to making a confirmed booking. Should you be in any doubt about the suitability of a property for any member of your party, please call us for clarification prior to making a booking.
Whilst every effort is made to ensure the safety of guests, the cottages and facilities at Atlantic View are used entirely at your own risk. Atlantic View, its employees, and representatives shall not be liable for any loss or damage to your property howsoever arising. You must take all necessary steps to safeguard your personal property and baggage. No responsibility can be accepted for loss or damage to motor cars.
WiFi service is provided with the expectation that speeds/data allowance may be limited and no compensation for data usage. WiFi may not be available at all times and is provided for pleasure and not business purposes. Bookings cannot be accepted if they are reliant on the provision of uninterrupted and unlimited provision of WiFi. When using the internet at the property, you agree to comply with all current legislation pertaining to and regarding the use of electronic data in using the internet provided by us. We cannot accept liability for loss or damage to your data or accept responsibility or liability for a guest’s inappropriate or illegal use of the internet.
RIGHT OF ENTRY
The owners of Atlantic View has the right to enter the property at any reasonable time to effect urgent essential repairs to the property or the fixture and fittings of the property and this right extends to any tradesperson or maintenance worker appointed by the owner. In an emergency where the safety or security of the premises or the occupants is endangered, or serious damage to the property would ensure if an emergency repair were not carried out, this right may be carried out day or night. We will endeavour to make the best possible arrangements for the continued comfort of the party and keep you informed about the progress of the work.
MATTERS BEYOND OUR CONTROL
We shall not be liable for changes, cancellations, or any other effect on your holiday due to administrative errors or events beyond our control (force majeure)
SORRY, NO DOGS OR PETS
We have made every effort to ensure that your holiday is enjoyable and trouble-free. If you do have a complaint or problem during your stay, please inform us immediately in order for us to take the opportunity to rectify and correct the situation as soon as possible. Any complaints or problems during your stay that have not been reported will not be considered at a later date.
ACCURACY OF DETAILS
We will describe the property honestly and as accurately as possible but cannot be warranted, nor do the descriptions form any contract. Whilst every effort is made to keep images and descriptions up to date services and facilities may alter. We reserve the right to update, improve and alter any of the subjects without notice.
We have adequate parking.
Only park vehicles in the designated parking spaces provided, such vehicles to be parked at your own risk.
